Rivas’ Growing Oklahoma Immigration Law Practice Featured

Less than one week after child support attorney Amy Page was featured in the Tulsa Business & Legal News, another Fry & Elder trial lawyer was profiled by the widely-read Oklahoma media publication. Fry & Elder immigration attorney Lorena Rivas, who has become no stranger to the media spotlight, was the subject of a feature story in the Tulsa Business & Legal News last week. The article, which you can READ HERE, was written by long-time legal reporter Ralph Schaefer and focused on Rivas’ thriving and growing Oklahoma immigration law practice from inside the Fry & Elder Tulsa offices.

Oklahoma immigration law attorney

The article highlights the impact Rivas’ Oklahoma immigration law practice has already had on Fry & Elder since joining the prolific Oklahoma firm in the fall of 2015.

Rivas was quoted in the article saying:

“I have helped because while the firm attorneys knew of immigration law, they really didn’t understand it. Now I have exposed them to the trials and complexities — whether it is difficulties with paperwork or the cultural barrier with clients. From a minority perspective, I think it has brought more of a cultural awareness because I was one of two females in at Fry & Elder when I joined the firm.”

A rising star in the world of immigration law, Rivas’ work provides a shining example of how many different legal realms – immigration law and criminal law included – can intersect with family law. Rivas now has a staff of five, which includes new associate Fry & Elder immigration law attorney Ruth Calvillo.

Much of the reason why Rivas’ immigration law services have been in such high-demand and often land her in Dallas courtrooms is because of the immigration policy changes the Trump administration seeks to implement and has already made.

Oklahoma immigration law practice

Rivas visited Capitol Hill and met with Oklahoma delegates, including U.S. Representative Tom Cole, during the annual American Immigration Lawyers Association’s National Day of Action. She also held the featured speaking position at a recent Tulsa County Bar Association seminar this past April.

Barteaux Appointed as Cherokee Nation District Court Judge

Luke Barteuax made Fry & Elder history inside a Cherokee County courtroom earlier this week. Barteaux became the first Fry & Elder attorney to be sworn in as a judge after he was appointed and confirmed as a Cherokee Nation District Court Judge in Tahlequah, Oklahoma on May 15, 2017 during its monthly council meetings.

Cherokee Nation District Court Judge

“I feel deeply honored to be appointed as District Judge, by Bill John Baker, Chief of the Cherokee Nation,” Barteaux said shortly after his confirmation. “My Native American heritage is very significant and sacred to me. To be able to assist and serve the Cherokee Nation in this type of capacity is quite an honor and a big responsibility.

“I would like to add that my commitment as a Fry & Elder trial lawyer will continue on a full-time level. My responsibilities as a Cherokee Nation District Court Judge are part-time and will require me to be in Tahlequah three days per month. Fry & Elder has given me tremendous opportunities to grow both professionally and personally. I am still fully committed to my work as an attorney at Fry & Elder.”

As Barteaux said, he will continue to actively practice law for Fry & Elder out of both the acclaimed Oklahoma law firm’s Tulsa and Oklahoma City offices. His accomplishments and accolades as an Oklahoma trial lawyer have been well documented and recognized by many. Barteaux has been named to Super Lawyers®Rising Stars™ the past four years and he served as the Chair for the Oklahoma Bar Association Family Law Section in 2016 and also way a participant in the Oklahoma Bar Association Leadership Academy for 2015-2016.

Cherokee Nation District Court Judge

The selection of Barteaux as its newest Cherokee Nation District Judge is one that excites the Tribal Council.

“We have an entire generation of tribal citizens who are better educated, and they will take us far in the future,” Tribal Council Speaker Joe Byrd said in Cherokee Nation release. “Like Luke Barteaux, they are pursuing careers in law, medicine, engineering and business. You know, Bart Fite brought a level of sophistication to our courts. I believe, given time, Barteaux will do the same.”

Elite Trial Advocacy Director Travels To Tulsa, Presents at Fry & Elder

The acclaimed Oklahoma law firm of Fry & Elder recently hosted elite company at the Robert G Fry Jr. Center for Trial Studies for the Oklahoma Bar Association Family Law Section Trial Advocacy Institute.

Trial Advocacy Director Charles H. Rose

Professor Charles H. Rose III, Director of the Center for Excellence in Advocacy and a Professor of Excellence in Trial Advocacy, traveled to Tulsa on April 22 to present to approximately 15 attorneys, four which were Fry & Elder’s M. Shane Henry, Aaron D. Bundy, Lorena Rivas and Amy Page. Needless to say, the esteemed professor came away impressed with the caliber of Oklahoma family law trial lawyer Fry & Elder and the state of Oklahoma produce.

“It was an absolute joy to spend Saturday working with some outstanding advocacy teachers,” Rose said. “Their commitment to the art and skill of trial work ensures that the family law section of the Oklahoma bar is in great hands.

“Rarely do you get the chance to work with other attorneys so committed to developing the advocacy skills of others. Tucked away in Oklahoma are some of the best teachers of trial advocacy.”

Rose’s remarks are notable for many reasons. First and foremost, Rose is a “nationally and internationally recognized expert in persuasion.” He spent 20 years on active duty in the United States Army in which he served as an intelligence officer, intelligence analyst, linguist and judge advocate before embarking on a full-time career in academia.

His persuasive techniques in trial are highly regarded and well documented.

“Professor Rose’s presentation was amazing,” Bundy said. “To be able to hear him present and offer his insight on persuasion and trial advocacy was a real treat and a very big deal.”

Rose’s visit further reiterates Fry & Elder’s continued commitment to professional development and continuing legal education. Bundy, Henry and Rivas already have traveled to New Orleans and Atlanta this year for continuing legal education seminars. Page held a seminar in March at the Robert G Fry Jr. Center for Trial Studies, while Rivas spoke a day before Rose at a CLE event sponsored by the Tulsa County Bar Association.

Rose isn’t the first high-profile legal stalwart to visit Fry & Elder. In 2015, renowned trial lawyer and best-selling author Roger Dodd visited the Robert G Fry Jr. Center for Trial Studies and presented a two-day seminar on cross-examination techniques.

Trial Advocacy

Fry & Elder’s continued commitment to trial advocacy and professional development is not surprising given the firm’s stature. The U.S. News & World Report has named Fry & Elder to its U.S. News & World Report’s Best Law Firm’s list from 2014-2017. Fry & Elder now also has office in Oklahoma City and features five attorneys who have received Super Lawyers® accolades, four attorneys who are AV® Preeminent Peer Review Rated by Martindale-Hubbell® and three of the past four Oklahoma Bar Association Family Law Section Chairs.

“The decision to support advocacy training so completely speaks to the character, quality and foresight of the Fry & Elder law firm,” Rose said. “The time we spent in their facility this weekend working with a group of true dedicated advocacy teaching professionals would not have been possible without the support of the firm. From top to bottom it is one of the most enjoyable training experiences I have had the pleasure of participating in.”

Fry & Elder Recognizes, Celebrates Talented Legal Support Staff

The only person who has been with Fry & Elder longer than Robert G “Hap” Fry Jr. is Joyce Caldwell. Not surprisingly, Caldwell is both revered and feared down the hallowed legal halls of Fry & Elder. She began working for C. Lawrence Elder in 1968 and has been closely aligned with the firm ever since, operating today as the acclaimed firm’s financial paralegal. Judy Willits’ tenure at Fry & Elder also expands over 40 years, having worked as Fry’s personal paralegal for a number of years.

While Caldwell and Willits are the most established members of the firm’s talented and efficient legal support staff, they are far from being the only notable members on a staff that also includes project coordinator Allison Smith and paralegals Deborah Lauderdale and Kathy Keener. In honor of National Administrative Professional Day, the group was celebrated Wednesday at the Robert G Fry Jr. Center for Trial Studies with gifts and cake.

“We have a very talented staff here and they are at the very core of it,” Fry said. “They just all do such a fantastic job. I’m not sure where I would really be, or the firm for the matter without Joyce and Judy. They know everything. I mean everything.”

Legal support staff

Though Fry & Elder’s decorated trial lawyers garner much of the spotlight, the firm’s talented legal support staff have unquestionably helped the Oklahoma law firm reach new heights. Fry & Elder Oklahoma City opened late last year, and the firm has been named to the prestigious U.S. News & World Report’s Best Law Firm’s list from 2014-2017. The firm also features five attorneys who have been recognized by Super Lawyers®, four attorneys who are AV® Preeminent Peer Review Rated by Martindale-Hubbell® and three of the past four Oklahoma Bar Association Family Law Section Chairs.

“Any success we have as attorneys is directly related to them; that I can promise you,” Henry said. “We are one big team here at Fry & Elder, and they are a very intricate part of that team.”

Lorena Rivas Helps Dispel Myths About Immigration Law At TCBA Seminar

The Tulsa County Bar Association held its 27th Annual Free CLE Seminar late last week, and the Fry & Elder presence at the event was strong.

Dispels myths about immigration law

Fry & Elder immigration law attorney Lorena Rivas held the featured speaking position – 1:00-1:50 p.m. – and her presentation “Mythbusters: Dispelling the Myths in Immigration Law” was well received by attorneys and legal personnel throughout the Tulsa area.

The accomplished immigration attorney dispelled 10 myths in regards to Oklahoma immigration law including:

  • A foreigner who is lawfully in the U.S. doesn’t have to worry about their immigration status
  • Deferred sentences and expungements are never seen by immigration officials
  • Someone who has been living in the U.S. for many years and has been U.S. citizen children can’t be removed
  • An employer can easily petition for someone to be able to remain in the U.S.

“I chose this topic to try to clarify some questions attorneys and people may have about immigration law, especially now because immigration is such a hot topic in the current presidential administration and political climate,” Rivas said.

Rivas has become authority figure in Oklahoma immigration law and her Fry & Elder immigration law practice is flourishing.

Earlier this month, Rivas traveled to Washington D.C. to take part in the American Immigration Lawyers Association’s National Day of Action. Rivas was there to advocate for immigration law reform in the U.S., and had a personal meeting with U.S. Representative Tom Cole. She also spoke to U.S. Senators James Inhofe and James Lankford, along with U.S. Representatives Frank Lucas, Markwayne Mullin and James Bridenstine.

Professional development and continuing legal education has long been a point of emphasis for Fry & Elder and its attorneys. In March, Fry & Elder partners M. Shane Henry and Aaron D. Bundy attended the National Association of Criminal Defense Lawyers® 2017 Midwinter Meeting & Seminar in New Orleans, while Rivas was at the Trial Lawyers College 2017 Georgia Regional Seminar: Direct Examination the same weekend.

“We’re always looking to improve and get better here,” Henry said. “It’s a concept that Lorena and all the other attorneys here at Fry & Elder buy into, and it has allowed us to grow as a firm.”

Experience the Fry & Elder Difference

The growth that Henry alluded to is evident in both the current stature and size of the firm. Fry & Elder now has a presence in Western Oklahoma with Oklahoma City offices. The firm now also has 12 practicing attorneys who concentrate on family law, criminal law and immigration law.

Fry & Elder’s accomplished staff of attorneys includes the Best Lawyers® Lawyer of the Year for Family Law in Tulsa for 2016, the 2016 Oklahoma Family Law Attorney of the Year by the Oklahoma Bar Association Family Law Section, five attorneys who have garnered Super Lawyers® accolades, four attorneys who are AV® Preeminent Peer Review Rated by Martindale-Hubbell® and three of the past four Oklahoma Bar Association Family Law Section Chairs. Oklahoma Immigration Law Attorney Lorena Rivas Visits Capitol Hill

The American Immigration Lawyers Association’s National Day of Action recently took place in Washington D.C., and the Oklahoma law firm of Fry & Elder was well represented. Fry & Elder’s Lorena Rivas not only attended the event, the accomplished Oklahoma immigration law attorney visited Capitol Hill last week to advocate for necessary reforms to America’s immigration system and to prevent policies that would hurt Oklahoma like mass deportations.

Oklahoma immigration law attorney Lorena Rivas

Rivas spoke to a captivated audience that included U.S. Senators James Inhofe and James Lankford, along with U.S. Representatives Frank Lucas, Markwayne Mullin and James Bridenstine. Rivas’ appearance at the event was highlighted by a personal meeting she had with U.S. Representative Tom Cole.

“I shared examples of real immigrants contributing to our community, and highlighted ways our laws could be reformed to increase our shared prosperity,” Lorena Rivas said from her Fry & Elder Tulsa office. “We need Congress to pass immigration reform that ensures America has smart, fair laws that will keep families together and help build our economy.  Every Oklahoman legislator seemed to understand the importance of immigrant labor and were genuinely concerned with the need of foreign workers.”

Oklahoma immigration law attorney Lorena Rivas

Rivas followed that statement up with a gripping and appealing call to action of Congress:

“When 9 out of 10 Americans support offering a path to citizenship for unauthorized immigrants living and working in our communities, an enforcement-only approach like the one President Trump is advocating isn’t pragmatic,” she said. “We need solutions, not more policies that cost taxpayers billions and don’t improve our national security.

“We all benefit when the best and the brightest from all over the world can come to America, bringing their creativity and innovative spirit and building new industries. Our country deserves a system that works, and to get there we need a comprehensive immigration reform bill. We need Congress to lead on this today.”

Lorena Rivas: A Rising Star in Oklahoma Immigration Law

Though five years removed from law school, Rivas already has established herself as an authority figure in Oklahoma immigration law whose legal prowess is in high demand throughout the state. Rivas provides comprehensive legal representation in the following areas of immigration law:

  • Asylum
  • Business Immigration
  • Citizenship/Naturalization
  • Deferred Action for Childhood Arrivals
  • Deportation/Removal Defense
  • Family Immigration
  • Fiancé Visa
  • Humanitarian Relief
  • Immigration Consequences of Criminal Activity
  • Special Immigrant Juvenile Status
  • Waivers

In 2016, Rivas was recognized by the Tulsa Business & Legal News as being one of the city’s most accomplished professional women with their annual Women of Distinction Awards.

A native of Mutual, Oklahoma, Rivas is a first-generation American who takes great pride in being able to represent the Oklahoma Latino community as an attorney.

“I’m a Mexican-American,” Lorena Rivas said. “Immigration law is something that is constantly hitting my life, whether it be family members, friends or my clients. In law school, I initially thought I wouldn’t go into immigration law, but I started thinking about it more, and felt like I could make a bigger impact in that area.”

Experience the Fry & Elder Difference

Rivas is just one of many standouts on a Fry & Elder legal team that features five attorneys who have garnered Super Lawyers® accolades, four attorneys who are AV® Preeminent Peer Review Rated by Martindale-Hubbell® and three of the past four Oklahoma Bar Association Family Law Section Chairs. Collectively, Fry & Elder’s lineup of attorneys, which now totals 12, have helped the firm be named to the prestigious U.S. News & World Report’s Best Law Firm’s list from 2014-2017. Whether you are in need of legal representation in immigration law, family law or criminal law in Tulsa or Oklahoma City, Fry & Elder has the team and resources in place to help navigate you through the process. Certified Life-Coach Attorney Weighs In On Travel Wardrobe Merits

At the forefront of every Oklahoma child custody decision is what is in the “best interest of the child.” Big decisions like what physician to use or what school to attend generate much discussion and often end in a heated dispute that needs to be settled by a judge’s ruling, but “little things” or items can also evoke conflict. Clothing might not be seen as an issue of potential conflict between parents, but it often turns out to be one of the biggest causes of strife between separated households.

Certified life-coach attorney

Fry & Elder certified life-coach attorney Melissa Fell’s practice focuses on legal and life-coaching services for parties going through a divorce. As a certified life-coach attorney, she knows the importance of addressing small, everyday issues before they grow into problems and offers the following tips when dealing with the issue of child clothing between separate houses.

Invest in a Travel Wardrobe

One way to squash out any potential issues with clothing between households is to invest in a travel wardrobe that can go to the other parent’s home and that you are not too concerned about getting back in a timely fashion. Walmart or other discount clothing stores are good spots to find items on sale.

As children are constantly growing, you need not have too many items at one time so that you can continue to supplement with the next size up.  It’s better for clothing to be a little big than too small.  Most children’s clothing can be found with elastic or adjustable waist and pant hems can be rolled or easily tacked up.  Be sure to always have properly fitting undergarments for your children, as they may not realize that they are too small and can cause discomfort. Keep an extra pair of shoes that can be worn for school and play (a pair of tennis shoes can go anywhere for a kid) and at least one extra jacket for any weather at your home.  Kids and parents tend to forget outerwear especially when the weather is nice one day and nasty the next as we see in Oklahoma all the time.

Keep Your Child out of any Clothing Issues

If your child is talking about getting his or her clothes back to you, then that means he or she has been told by you to get them back. Whether you meant to or not, you have now involved your child in an adult issue.

Certified life-coach attorney

Clothing and the responsibility to get them back to a parent’s home should not be a concern of a child.  When a parent puts pressure on the child to do something, and the parent on the other side disagrees or they want to make an issue out of it, it only serves to put the child in the middle and cause stress for that child. Instead, have them wear a set of size and weather appropriate clothing that is not expensive or fancy that you are not fixated on having immediately returned when they are going to the other parent’s home.  If you do need the clothing home immediately, or if you think that the outfit your child wore over to the other parent’s home may not be appropriate to wear on their return day, pack an outfit for them to wear home in into their backpack.  Almost every child carries a backpack that can accommodate one change of clothes.

If you are respectful of the other parent’s items (wash according to directions, have the child wear them back as soon as practical) and provide what the child will need when they are at the other parent’s home, then you are looking out for your child’s best interest.  Try to work out a system so that you send your child home in the outfit they wore over to your house previously from the other parent’s wardrobe.  It should not have to be the next day, since wearing the same clothes two days in a row may be embarrassing to a child, but you should be able to rotate outfits at least every 3rd time, depending on the structure and frequency of visitation.  If you and the other parent cannot agree on this system, then we help get this incorporated into an agreement or order for you.

Why Consult with a Proven and Certified Life-Coach Attorney?

Don’t use clothing and personal items as a tool to fight with the other parent.  It only causes more conflict and may impair your ability to secure the custody and visitation that you are seeking.  If this is a source of conflict, contact Fry & Elder today to set up a personal consultation with Melissa Fell. As a proven certified life-coach attorney, Melissa will help you address it in a manner that will not put you or your children in the middle. The divorce and child custody attorneys at Fry & Elder Tulsa and Fry & Elder Oklahoma City are here to help with the big issues, as well as the small, everyday problems that grow into bigger issues if not addressed.

Melissa can coach you in ways to make your co-parenting experience more peaceful and calm for both you and your children, and to help you secure the custody and visitation you see as best for your children.

Tulsa World Takes Notice of Henry’s Work in Tulsa Murder Trial

Fry & Elder partner M. Shane Henry was named the 2016 Oklahoma Family Law Attorney of the Year by Oklahoma Bar Association Family Law Section. But as Henry proved this past week inside a packed Tulsa County courtroom, there is more to his repertoire as an accomplished trial lawyer than just family law. Henry was part of the criminal defense in a high-profile Tulsa murder trial involving defendant James Vasco Jones. After months of trial preparation, Henry’s role at trial included making the defense’ opening statement to the jury and cross-examination of a co-defendant who testified for the state. His cross-examination of co-defendant Sidney Aaron Randall was spotlighted in a Tulsa World article about the case.

Tulsa murder trial

“Shane’s cross-examination of the co-defendant(s) was really strong,” said fellow Fry & Elder partner Aaron D. Bundy, who observed the trial. “Shane highlighted points he made in his opening statement: that constant use of methamphetamine impaired the witness’ memory and that the witness a had strong motive to testify the way he did due to a deal he had cut with the state. Shane’s cross really raised important questions about the strength of the state’s case.”

Henry and Bundy recently attended the National Association of Criminal Defense Lawyers® 2017 Midwinter Meeting & Seminar in New Orleans in which acclaimed criminal defense lawyer Barry Scheck – O.J. Simpson legal defense team and co-founder of the Innocence Project – served as the keynote speaker.

Tulsa murder trial

He also is the second Fry & Elder attorney to work as part of the criminal defense in a high-profile Tulsa murder trial since December. Fry & Elder’s Kirsten Bernhardt was part of Cedric Poore’s criminal defense team and also was featured in a Tulsa World article covering the trial.

Fry & Elder has been synonymous with Oklahoma family law for over 40 years and will always focus much of its legal efforts in the realm of family law, but the firm has expanded its legal reach the past few years. The iconic law firm now has offices in Oklahoma City, and Henry and Bernhardt’s recent criminal defense efforts provide further evidence of Fry & Elder’s growth. Whether you are in need of a family law, criminal defense, immigration law or personal injury law attorney, Fry & Elder has the trial lawyers in place to suit your legal needs.
