Appeals

Oklahoma appeals process

When decisions don’t go your way in the court of law, and you think that a mistake was made in the process, the Tulsa law firm of Fry & Elder wants you to know that you are entitled to an appeal.

While we are most known for our work at trial in Tulsa divorce, child custody and child support proceedings, we also offer many other legal services, including Oklahoma appellate services.

In fact, for decades, Fry & Elder appellate lawyers have successfully argued to both the Oklahoma Court of Civil Appeals and to the Oklahoma Supreme Court, and as a result Fry & Elder’s appellate advocacy has contributed to the development and progress of family law in Oklahoma.

What is an appeal?

Simply put: an appeal is when you request that a higher court review a decision or order that was made by the original court you went to first.  If you think there was a mistake made in your case, you are entitled to ask that it be reviewed and reversed.

How are appeals in Oklahoma filed?

The Oklahoma appeals process and elsewhere are based on error. Mere dissatisfaction with a judge or jury’s decision is not enough if the trial was fair and there was no legal error that harmed you.

To bring a successful appeal, you must have a legal reason. Again, these typically come in the form of mistakes that are made during a trial.

What are the common grounds for filing an appeal in Oklahoma?

Any number of contributing factors could warrant the basis for an appeal including but not limited to all of the following below:

  • Jurisdictional issues
  • Abuse of the trial court’s discretion
  • Misapplication of the law
  • Evidentiary rulings
  • Constitutional issues

Why the Need for an Attorney Experienced in the Oklahoma Appeals Process?

If you think a mistake or mistakes were made in your case, it is strongly recommended that you retain the services of an experienced and reputable Oklahoma appellate lawyer, who has experience in navigating through the Oklahoma appeals process. After a judgment is entered, there may be very little time to bring an appeal.
