Tulsa Divorce Lawyers Discuss Divorce and Taxes

Tulsa divorce lawyers

For many, the tax season is already up on us – the filing deadline is April 18 – but before it completely consumes the rest of us up, the Tulsa divorce lawyers of Fry & Elder wish to give you a few pointers on how you can better manage the challenge of filing your taxes if you are going through a divorce.

Know you filing status

How you file your taxes this year will be based on what your marital status was on Dec. 31, 2015 at 11:59 p.m. If your ex and you were divorced by this time then you will file for separate returns. However, if you two were just separated at this time and had not yet formally divorced, you do have the option of filing a joint return, which you might want to consider. There are benefits though that come with filing as the head of the household – such as being put into a more forgiving tax bracket and also receiving a larger standard deduction.

Understand the exemptions for dependents

If your child has lived with you for the greater duration of the past year than with your ex, you can claim him or her as a dependent on this year’s tax return, as you are deemed the child’s custodial parent. Non-custodial parents can only claim their children as dependents if the custodial parent signs a waiver notifying the courts that he or she will not claim custodial parent status. Whichever parent does claim a qualifying child as a dependent on their tax return will be able to reduce their 2016 taxable income by $4,050. The amount was $4,000 in 2015.

Factoring in medical expenses

If you are the parent who has paid your child’s medical expenses after the divorce, those expenses can be included in your medical expense deduction. This is true regardless of whether or not your ex is the custodial parent and has claimed a dependency exemption.

Home sales

In regards to the sale of a house, typically the law will allow you to avoid tax on the first $250,000 gain of your primary home, permitted you have lived there for at least two of the past five years. Couples who are still married and file jointly can exclude up to $500,000.

Why a team of knowledgeable Tulsa divorce lawyers can help you

Going through a divorce is complicated enough, factoring all of the tax innuendos compounds the process even more. Fortunately, the Tulsa divorce lawyers at Fry & Elder are well versed in the most complex family law matters. The firm has achieved in elite national reputation, as evidence by it being named to the U.S. News & World Report’s exclusive list of Best Law Firms from 2014-2016.

Valentine’s Day and Divorce Might Go Together

Valentine's Day and Divorce

Valentine’s Day typically is associated with flowers, candy and romance. But according to some recent studies, Valentine’s Day and Divorce might go hand-in-hand. According to the reputable legal site Avvo.com, there is a 40 percent increase in people making inquiries about divorce in the brief period leading up to and after Valentine’s Day.

In the article, Philadelphia attorney Jennifer A Brandt said: “Valentine’s Day seems to be a natural catalyst for people to evaluate, and in some cases, make a change in their relationship. I see a distinct pattern where people take honest stock of their relationship in the New Year and make the difficult decision to seek divorce by Valentine’s Day.”

Additionally, AttorneyFee.com reported that divorce fillings in February reach a peak — increasing by nearly 20 percent — in California, Illinois and New York.

Why the spike in Valentine’s Day-related divorces?

There are number of things that could be attributed to the increase in divorce fillings around Valentine’s Day. Stress from the holidays can often prompt thoughts about divorce. Many people will wait until after the New Year to follow through because of the benefits that come with the calendar changes – such as a new tax year – or people are just ready to make big changes with their lives.

The disadvantages that come with the turning of a new year also could play a factor. January has historically been the busiest month for bankruptcy filings, which leads to numerous stressful situations for couples. Cold weather also could lead to increased tension due to the fact that the couple is forced to spend more time together in close proximity.

What should you do if your spouse or you file for divorce?

Whether it’s around Valentine’s Day or at any other time of the year, you are going to want to immediately contact an experienced and proven family law attorney. Divorce and child custody issues are each unique and complex, making it all the more imperative to consult with an experienced divorce and child custody lawyer.

The Tulsa divorce lawyers of Fry & Elder are well versed in handling both high-conflict, high-resolution as well as family law matter in which both sides are amicable and willing to work together to get an acceptable resolution for each party.

Fry Praises American Academy of Matrimonial Lawyers

Dad, Clarke & Badger

Of all the accolades Robert G “Hap” Fry Jr. has garnered during an illustrious career as a prominent Tulsa divorce and child custody attorney, perhaps no honor is held with higher regard than being a Fellow of the American Academy of Matrimonial Lawyers.

Fry, who has been practicing family law for over 35 years, was recently honored as the Lawyer of the Year for Family Law in Tulsa for 2016 by Best Lawyers® and has been selected as an Oklahoma Super Lawyer every year since 2007. Additionally, he carries an AV Preeminent rating by Martindale-Hubble.

Still as esteemed as those honors are, to be a Fellow of the American Academy of Matrimonial Lawyers is to be considered one of the elite family law practitioners in the country. In fact, there are fewer than 1,700 “Fellows” in the United States.

What Separates a “Fellow” From Other Family Law Attorneys

Founded in 1962, the ultimate purpose of the American Academy of Matrimonial Lawyers is “to provide leadership that promotes the highest degree of professionalism and excellence in the practice of family law.”

The AAML website goes on to say that being a Fellow of the American Academy of Matrimonial Lawyers means that:

  • “The attorney has demonstrated an active interest and competency in matrimonial law as evidenced by the fulfillment of criteria and standards as established by the AAML™ Board of Examiners and Board of Governors.”
  • “The attorney has substantial experience and is able to handle complex matters relating to custody and support of children, property division and alimony or spousal support.”
  • “The attorney has demonstrated an active interest and competency in matrimonial law as evidenced by the fulfillment of criteria and standards as established by the AAML™ Board of Examiners and Board of Governors.”
  • “The attorney is recognized by the bench and bar as a leading practitioner in the area of matrimonial law.”
  • “The attorney has demonstrated substantial involvement in the matrimonial field and has endeavored to encourage the study, improve the practice, elevate the standards and advance the cause of matrimonial law.”

Not Just a “Fellow,” but a Difference Maker

As a leading Tulsa divorce and child custody attorney, Fry has been active in the American Academy of Matrimonial Lawyers for over 25 years. Fry served as the AAML Oklahoma Chapter President from 2001-2003 and on the AAML National Board from 1992-1993 as the Chairman for the Special Concerns of Children Committee.

“The American Academy of Matrimonial Lawyers truly is an outstanding organization that has provided me with significant opportunities for personal and professional grown both in and out of the courtroom,” Fry said. “The leadership and resources they provide really are second to none in family law.”

Experience the Fry & Elder Difference

Exercise Caution this Super Bowl (Guest Blog)

Tulsa criminal defense attorneys

The Super Bowl is just a few days away, and while it’s a great day to gather with friends and family to celebrate the final day of football season, the unfortunate reality is that sometimes the fun can be a taken a little too far. Law enforcement will be on the lookout for those that have had too much to drink to drive safely. And while we encourage everyone to use good judgment when assessing your ability to drive safely, if you are stopped for DUI you are entitled to a strong and rigorous defense.

How Can We Defend Your DUI Case?

There are a number of problems that can occur during the course of any DUI arrest. These issues must be understood and identified to present the best and most thorough defense. The following are just a few of the potential defenses that may be used to challenge your DUI charge by Fry & Elder’s Tulsa criminal defense attorneys.

Improper Stop/Arrest:

The United States Constitution prohibits searches and seizures without probable cause. In the context of your DUI case, this means that law enforcement must have a reason to stop you and must establish probable cause before arresting you. If law enforcement has not complied with these constitutional requirements, any evidence they have obtained may be deemed inadmissible and your charges thrown out.

Improper Administration of the Field Sobriety Tests:

The National Highway Traffic Safety Administration (NHTSA) has developed guidelines for standardized field sobriety testing. These standardized tests (walk-and-turn, one-leg stand, and horizontal gaze nystagmus) must be administered and assessed according to NHTSA guidelines. If law enforcement does not properly instruct, demonstrate, and assess these standardized tests according to NHTSA guidelines (or, if officers are using non-standardized tests), the improper tests or results must be challenged before trial.

Faulty Breath Tests:

In addition to problems with the stop or field sobriety testing, law enforcement may perform flawed breath or blood testing. Broken or misused equipment, medical conditions, mouth alcohol, and failure to follow proper procedures are just a few of the issues that can affect your blood alcohol content (BAC) reading. Because these results, even if faulty, will used against you by the prosecution, any breath or blood test result must be thoroughly investigated to determine if any improper testing procedures may have inflated your BAC.

Being charged with DUI can carry serious personal, financial, and employment consequences. The experienced  Tulsa criminal defense attorneys at Fry & Elder will work hard to make sure you have the best possible defense to guard against these dramatic consequences.

Why A Qualified Domestic Relations Order Is Important In A Divorce

If you are contemplating or are on the brink of going through a divorce, and you want to ensure that you will receive your Erisa-qualified retirement assets, you would be wise to have a Qualified Domestic Relations Order prepared by an experienced and knowledgeable team of Tulsa family law attorneys.

Qualified Domestic Relations Order

Below are a few answers to some of the more commonly asked question about Quality Domestic Relations Orders or QDROs from the Tulsa family law firm of Fry & Elder.

What is a Qualified Domestic Relations Order and why the need for one?

The fact of the matter is going through a divorce is difficult enough without the added pressure of dividing retirement funds. If a premarital agreement was not written up then generally any assets that have been acquired by either party during a marriage are considered marital. Things like contributions to a retirement plan by the employee or employer are included.

QDROs are important documents because they are required for things for 401(k)s, pensions, 403(b)s and some other retirement plans that you might have set up with your company.

Why consult with an experienced family law attorney to draft out a Qualified Domestic Relations Order?

Like a lot of things associated with divorce and specifically the financial aspects of divorce, QDROs are more complex than you might initially think.

While there are some outlets that include model language on how a QDRO should be written up, an experienced family law attorney will help minimize the risks of any potential errors. This is all the more important through the review and approval process before you hand it over to the court to be signed as an order and ultimately get it incorporated into the Final Judgement of Dissolution of Marriage.

Experience the Fry & Elder Difference

Since 1932, the name Fry & Elder has been synonymous with Oklahoma legal excellence.

The firm has been named to highly-regarded U.S. News & World Report’s Best Law Firms List each of the past five years and its attorneys include the following:

  • Best Lawyers® Lawyer of the Year for Family Law in Oklahoma 2016
  • Four attorneys recognized by Super Lawyers®
  • Three attorneys AV® Preeminent Peer Review Rated by Martindale-Hubbell®
  • A Cherokee Nation District Court Judge
  • The 2018 Fern Holland Award Winner
  • A 2017 OBA Earl Sneed Award Recipient
  • The 2018 Tulsa County Bar Association Family Law Section Chair
  • A 2017 Significant Sig Award Winner

As you can see, the division of retirement assets during a divorce can be tricky and time consuming, making it all the more important to utilize the services of a well versed Tulsa family law attorney, particularly to make sure that everything is properly divided through the implementation of a well thought out Qualified Domestic Relations Order.

Contact Fry & Elder today to get started on your Qualified Domestic Relations Order.

Tips for Dealing with a Narcissist During a Divorce

Divorce is tough. Going through one with a narcissist makes it all the more difficult. While the Tulsa divorce law firm of Fry & Elder hopes that everyone going through a divorce has an amicable separation, the reality is that sometimes that is not possible – particularly if your ex suffers from a narcissistic personality disorder. The problem is that much more compounded if you are going through a custody battle. Because many people are not in tune with the personality disorders of a narcissist, the Oklahoma divorce attorneys of Fry & Elder want to share a few tips for you if you are going through a separation with a narcissist.

Tulsa criminal defense attorney

Prepare Yourself and Take the High Road

The nature of a narcissist is to be deviant and manipulative. Like a flash in the pan, this can carry a lot of weight initially. Chances are he or she will run a smear campaign against you and try and turn your friends and even family members against you.

While these tactics might work early on, people, particularly those close to you, will wise up and see the true colors of a narcissist. As difficult as it might be early on, Fry & Elder’s team of divorce attorneys urge you to think a few steps ahead and take the high road. A narcissist’s true colors will eventually show – it is inevitable.

Get Dialed In

You’re not going to change a narcissist’s personality, so you need to document it. Our firm suggests that you keep an ongoing journal of your ex’s erratic and deceiving behavior. You also should try and limit communication with your ex. This might be difficult, especially if you are battling over custody, but Fry & Elder recommends that you keep a file of any correspondence that you do have with he or she. Sticking to email would be the best course of action, but if there is texting involved, you should keep a record of them. Title and document as much as you can such as “Failure to Allow Visitation on 10/31/15,” and try and keep phone conversations to a minimum.

Consult with a Talented Team of Oklahoma Divorce Attorneys

The Oklahoma divorce attorneys of Fry & Elder are not just some of the most decorated not just in the state, but in the country. Robert G “Hap” Fry Jr. was selected as the Lawyer of the Year for Family Law in Tulsa for 2016 by the leading legal publication Best Lawyers®. Fry & Elder attorneys M. Shane Henry, James R. Elder and Aaron D. Bundy, along with Fry, have all garnered the coveted AV® Preeminent Peer Review Rating by Martindale-Hubbell®, which is a testament to the fact that a lawyer’s peers rank him or her at the highest level of professional excellence. Henry, Bundy and T. Luke Barteaux also have been selected as Super Lawyers® Rising Stars™.

These five attorneys, along with Lorena Rivas, Katie Egan and Melissa Fell have helped distinguish Fry & Elder as one of the premier family law firms in the United States. Why Gray Divorce is on the Rise

Experienced Tulsa divorce attorney

An experienced Tulsa divorce attorney knows that divorce can happen at any point during a marriage, but a segment of the population where divorce is on the rise might be a surprise to many. The American Academy of Matrimonial Lawyers (AAML) released the results of a survey in which 61 percent of the nation’s top divorce lawyers said there have been a spike in divorces for couples 50 and over. Not long after AAML’s report, NPR backed that up with a 2014 article and broadcast that stated that “Americans over 50 are twice as likely to get divorced as people of that age were 20 years ago.” The Tulsa divorce attorneys of Fry & Elder are aware of this trend and are experienced in handling divorce for older couples. Here a few things our divorce attorneys would like you to know about what is now referred to as “Gray Divorce.”

Why the increase in divorce for older couples?

It is difficult to say because all relationships are different and present their own unique set of circumstances. There have been some studies that suggest that the spike could be tied to the fact that many older people might be on their second or third marriage, but other studies indicate that over half of gray divorces occur between couples in their first marriage. This is might be attributed to the fact that life expectancy is higher than in years past and also because women are more financially independent and stable.  Another theory on why older couples are going through divorce is because in some instances raising children together may be biggest thing a couple has in common. When the children grow up and move out that shared interest and investment also leaves to an extent. Growing expectations of how and what a successful marriage is probably is an additional factor in why older couples are growing apart at a more accelerated rate.

How can an experienced Tulsa divorce attorney help?

At the Tulsa family law firm of Fry & Elder, we cater and tailor to each individual’s specific needs, making sure that each case is given the attention and legal expertise it commands. Our team of family law attorneys are some of the most decorated in both the state and the nation. Robert G “Hap” Fry Jr. has been selected by the leading legal publication Best Lawyers® as its Lawyer of the Year for Family Law in Tulsa for 2016, and he has been listed by the same publication as an Oklahoma Super Lawyer every year since 2007 to validate himself as an accomplished and experienced Tulsa divorce attorney.

Fellow Fry & Elder divorce lawyers James R. Elder, M. Shane Henry, Aaron D. Bundy and T. Luke Bartueax also have collected their share of accolades. Elder, Henry and Bundy, along with Fry have each garnered the prestigious AV® Preeminent Peer Review Rating by Martindale-Hubbell®, which is a testament to the fact that a lawyer’s peers rank him or her at the highest level of professional excellence. Henry, Bundy and Barteaux also have been selected as Super Lawyers® Rising Stars™.

Collectively, the group has helped Fry & Elder achieve national recognition with the firm being recognized by the U.S. News & World Report as one of the nation’s Best Law Firms from 2014-2016. Tulsa Immigration Law Attorney Gives Back

Tulsa immigration law attorney

As an up-and-coming Tulsa immigration law attorney, Fry & Elder’s Lorena Rivas got into law so that she could make a positive impact on her heritage and her community. While at the University of Tulsa College of Law not only did Rivas graduate with honors, she successfully prevented a Haitian national from being returned to Haiti, in terrible conditions due to a recent earthquake and hurricane. If that weren’t enough, she also helped a mother and her two children remain in the United States after being victims of domestic and sexual abuse in Mexico.

Four years later, Rivas’ impact continues to be felt. Rivas appeared on the popular Tulsa Hispanic radio station Que Buena (1530AM & 100.3FM) Friday morning to discuss how the Supreme Court has agreed to hear arguments about the recent executive action on immigration by President Obama. A video of Rivas’ appearance on the station’s Pico de Gallo Morning Show can be viewed by CLICKING HERE. The video is in Spanish, and those wishing to view the Fry & Elder website in Spanish now have the option to do so on any page.

Rivas followed up Friday’s performance on Saturday by bringing in the Union Alternative High School mock trial team to the recently opened Robert G Fry Jr. Center for Trial Studies. Rivas coaches the high school’s mock trial team to provide further evidence that she is a community-driven Tulsa immigration law attorney.

“I’ve always been proud of my Mexican-American heritage and the Tulsa community that I live in,” Rivas said. “I know all the attorneys at Fry & Elder and I feel strongly about giving back to the community and being involved in it. For me, it’s important to educate the Hispanic community on their rights.

“Immigration law is something that is constantly hitting my life, whether it is family members, friends or my clients. In law school, I initially thought I wouldn’t go into immigration law, but I started thinking about it more, and felt like I could make a bigger impact in that area.”

An accomplished Tulsa immigration law attorney

While Rivas is only in her fourth year practicing law, there is little doubt that she is a rapidly growing star in the world of immigration law. She is a member of the American Immigration Lawyers Association (AILA) and Hispanic National Bar Association (HNBA).

“She’s definitely a rising star,” Fry & Elder partner M. Shane Henry said. “She brings a unique skill set and a lot of diversity to our firm. She has only helped us grow and has further enhanced our reputation.”

Rivas’ practice focuses on individuals who are in need of legal counsel with complicated U.S. immigration laws in affirmative and defensive immigration policies before the Department of Homeland Security. Rivas’ practice areas at Fry & Elder include:

  • Asylum
  • Business Immigration
  • Citizenship/Naturalization
  • Deferred Action for Childhood Arrivals
  • Deportation/Removal Defense
  • Family Immigration
  • Fiancé Visa
  • Humanitarian Relief

If Spanish is your native language, and the one you are most comfortable communicating in then it would be in your best interest to seek consultation with a proven and accomplished Tulsa Spanish speaking attorney.

Fry & Elder’s Lorena Rivas not only is a Tulsa Spanish speaking attorney, but one that is experienced and well versed in handling a number of Tulsa immigration law issues. As a member of the American Immigration Lawyers Association (AILA) and Hispanic National Bar Association (HNBA), Rivas provides a host of immigration law services that include:

  • Asylum
  • Business Immigration
  • Citizenship/Naturalization
  • Deferred Action for Childhood Arrivals
  • Deportation/Removal Defense
  • Family Immigration
  • Fiancé Visa
  • Humanitarian Relief
  • Immigration Consequences of Criminal Activity
  • Special Immigrant Juvenile Status
  • Waivers

“Immigration law is something that is constantly hitting my life, whether it be family members, friends or my clients,” Rivas said. “In law school, I initially thought I wouldn’t go into immigration law, but I started thinking about it more, and felt like I could make a bigger impact in that area. “I got into family law because of my background in immigration law. If you’re practicing immigration law, you’re going to be dealing a lot with family law.”
