Why Social Media and Divorce is not a Match Made in Heaven

The old adage in academia among tenured professors often is “publish or perish.” That said, there is good reason why they are not practicing attorneys today. Case in point: when it comes to social media and divorce – Facebook in particular – almost every lawyer will spin things in a different way. “Publish and then perish” is what a growing number of divorce attorneys will preach to their clients. Remaining active on Facebook and other social media sites during a high-conflict divorce or child custody battle can have big consequences. Facebook is almost as universally used as email, making it a leading form of communication, and the courts have taken notice.

Big Developments between Social Media and Divorce

After failing for years to locate her husband and serve him with divorce papers, a New York judge allowed a woman to go online – use Facebook – to have him served. Click HERE to read the story as reported by CNN.

Before gaining approval to take to the internet, Ellanora Arthur Baidoo had to prove to Judge Matthew Cooper that the Facebook account was in fact her husband’s and that he frequently accessed and used it, meaning that he would see the divorce papers.

CNN reported that Judge Cooper said the following in his ruling: “advent and ascendency of social media,” means sites like Facebook and Twitter are the “next frontier” as “forums through which a summons can be delivered.”

Misuse of social media sites like Facebook also can lead to violation of protective orders, as evidenced by a case last summer in Pennsylvania in which a man was arraigned on contempt of court charges after he liked over 20 of his former girlfriend’s pictures on Facebook. If that were not enough, the man took it a step further and proceeded to further violate his protective order after he told the victim that he would “shoot her knee cap to watch her suffer.” Click HERE to read the reported story.

Tulsa Divorce Lawyers Discuss Divorce and Taxes

For many, the tax season is already up on us – the filing deadline is April 18 – but before it completely consumes the rest of us up, the Tulsa divorce lawyers of Fry & Elder wish to give you a few pointers on how you can better manage the challenge of filing your taxes if you are going through a divorce.

Know you filing status

How you file your taxes this year will be based on what your marital status was on Dec. 31, 2015 at 11:59 p.m. If your ex and you were divorced by this time then you will file for separate returns. However, if you two were just separated at this time and had not yet formally divorced, you do have the option of filing a joint return, which you might want to consider. There are benefits though that come with filing as the head of the household – such as being put into a more forgiving tax bracket and also receiving a larger standard deduction.

Understand the exemptions for dependents

If your child has lived with you for the greater duration of the past year than with your ex, you can claim him or her as a dependent on this year’s tax return, as you are deemed the child’s custodial parent. Non-custodial parents can only claim their children as dependents if the custodial parent signs a waiver notifying the courts that he or she will not claim custodial parent status. Whichever parent does claim a qualifying child as a dependent on their tax return will be able to reduce their 2016 taxable income by $4,050. The amount was $4,000 in 2015.

Factoring in medical expenses

If you are the parent who has paid your child’s medical expenses after the divorce, those expenses can be included in your medical expense deduction. This is true regardless of whether or not your ex is the custodial parent and has claimed a dependency exemption.

Home sales

In regards to the sale of a house, typically the law will allow you to avoid tax on the first $250,000 gain of your primary home, permitted you have lived there for at least two of the past five years. Couples who are still married and file jointly can exclude up to $500,000.

According to the reputable legal site Avvo.com, there is a 40 percent increase in people making inquiries about divorce in the brief period leading up to and after Valentine’s Day.

In the article, Philadelphia attorney Jennifer A Brandt said: “Valentine’s Day seems to be a natural catalyst for people to evaluate, and in some cases, make a change in their relationship. I see a distinct pattern where people take honest stock of their relationship in the New Year and make the difficult decision to seek divorce by Valentine’s Day.”

Additionally, AttorneyFee.com reported that divorce fillings in February reach a peak — increasing by nearly 20 percent — in California, Illinois and New York.

Why Gray Divorce is on the Rise
