Possible Legal Implications for Oklahoma Licensed Professioals

Oklahoma trial lawyers

Simply being involved in any legal action is serious and stressful, but the stakes can be heightened when your job is on the line.

Professionals, such as doctors, lawyers, counselors and police officers, are all regulated and must have a license from the State in order to work in their respective areas. As those professions all have significant educational and training requirements, each professional license is the product of thousands of hours of effort, investment and education.

Professional licenses all have a “requisite moral character” component, and licenses can be placed in jeopardy by allegations of professional or personal misconduct made in protective orders and divorce cases and criminal charges with complaints to the licensing body. If you find yourself going through such a legal issue, it is imperative that you speak with an Oklahoma trial lawyer in a timely matter to discuss the possible implications of what is at stake for you professionally.

The Oklahoma trial lawyers at Fry & Elder represent professionals including lawyers, doctors and police officers in licensure hearings, criminal cases and family law matters. If you have a professional license and are the subject of a complaint, consider the following tips:

  • Contact a lawyer before speaking to an investigator. An attorney can assist you concerning any potential questioning
  • Preserve your records
  • Do not ignore an investigation, regardless whether it is justified or not
  • Do not contact the complainant
  • Do not discuss the complaint publicly, including social media

The trial lawyers at Fry & Elder handle sensitive matters where parental rights, licenses and liberty are at stake.

Why Consider Fry & Elder Oklahoma Trial Lawyers

The Oklahoma trial lawyers of Fry & Elder are not only some of the most decorated in the state, but in the country. This much has been evident in the national recognition the firm has commanded. The U.S. News & World Report recently named the firm to its Best Law Firms list for a fourth consecutive year. Individually, Oklahoma trial lawyers Robert G “Hap” Fry Jr., M. Shane Henry, Aaron D. Bundy and T. Luke Barteaux all garnered Super Lawyers® accolades. Even more impressive is the fact that Fry was named the Lawyer of the Year for Family Law in Tulsa for 2016 by Best Lawyers®, while Henry was just named the 2016 Family Law Attorney of the Year by the Oklahoma Bar Association Family Law Section.

Additionally, Fry & Elder’s Lorena Rivas is one of the most acclaimed Oklahoma immigration law attorneys, while Kirsten Bernhardt has previously won a judgement in excess of $10 million from Coca-Cola and is an accomplished litigator in guardianships, family law and criminal law cases.

In addition to Oklahoma, Fry & Elder attorney Katie Egan is licensed to practice in New York and Connecticut. Melissa Fell focuses much of her practice on the increasingly popular concierge attorney, while partner James R. Elder is one of four Oklahoma trial lawyers at the firm to hold the distinguished AV® Preeminent Peer Review Rating by Martindale-Hubbell®. Contact Fry & Elder today to speak with an experienced and accomplished Oklahoma trial lawyer.

Tulsa Lawyer Magazine Publishes Fry & Elder Attorneys Work

Tulsa Lawyer Magazine

M. Shane Henry

Oklahoma trial lawyers M. Shane Henry and Aaron D. Bundy are at it again. The two Fry & Elder partners, SuperLawyers® Rising Stars and AV-Rated attorneys have co-authored their third article of the calendar year for Tulsa Lawyer Magazine. Henry and Bundy’s most recent effort, titled “Connecting in the Courtroom” is featured in this month’s edition of Tulsa Lawyer Magazine. CLICK HERE to read the article in its entirety.

“Just another great opportunity for Shane and I,” Bundy said. “We’ve been fortunate to have the opportunity to publish some of what we’ve learned from our experiences in the courtroom for Tulsa Lawyer Magazine. Our passion is being in the courtroom trying cases and advocating for our clients, but it’s been a lot of fun for us to collaborate together on these articles. We plan on writing more of these articles in the future.”

Just as the title suggests, Henry and Bundy’s latest article deals with how essential it is for trial lawyers to establish good connections between themselves and their clients with the court’s decision makers – judges and juries.

As Henry and Bundy wrote: “Connection leads to understanding.”

One technique to better ensure this understanding takes place is to have the court’s decision makers not just focus on “what” the client did, but to have them understand “why” the client did.

Below our links to Henry and Bundy’s other published works, including a 2015 piece for the Oklahoma Bar Association.

Their reputations as accomplished litigators and educators have helped Henry and Bundy earn the title of Co-Chairs for the Litigation Section of the Tulsa County Bar Association.

Henry and Bundy are not the only highly-decorated attorneys at Fry & Elder. Robert G “Hap” Fry is one of only 19 attorneys in the state to be named a  Fellow of the American Academy of Matrimonial Lawyers. He also was named the Lawyer of the Year for Family Law in Tulsa for 2016 by the renown legal publication Best Lawyers®. Like Henry and Bundy, Fry and fellow partner James R. Elder also are AV-Rated attorneys.

Luke Barteaux focuses much of his practice on adoptions and also is a SuperLawyers® Rising Star, while Lorena Rivas is a highly-regarded Oklahoma immigration law attorney. The firm’s Kirsten Bernhardt is a proven litigator in guardianships, family law and criminal law, who has won a judgement in excess of $10 million from Coca-Cola.

Melissa Fell focuses much of her family law practice on the “concierge attorney” approach, and Fry & Elder’s Katie Egan is licensed to practice in three different states. Collectively, the group of attorneys is one of the most accomplished in the state and has helped Fry & Elder to the U.S. News & World Report’s prestigious list of Best Law Firms from 2014-2016. Contact Fry & Elder today.

Tulsa Adoption Practices and Elsewhere are Changing

Tulsa adoption practices

Luke Barteaux

There has been a changing of the guard so to speak in Tulsa adoption practices and those around the country. A team of professors at the University of Missouri did an in-depth research study that uncovered that “open” adoptions benefit both the child and the adoptive parents.

Most Tulsa adoption practices and elsewhere throughout the majority of 20th century were “closed,” meaning that communication lines between the birth parents and adoptive parents were largely never established because the birth parents would place their child with an adoption agency. Unless the child sought their birth parents out late in life, there would be no further contact.

In the 1990s, however, a shift from “closed” adoption to “open” adoption practices began to occur after adoption practitioners began to notice the benefits of “open” adoptions where the communication lines between the birth and adoptive parents were open.

“In the past, closed adoptions severely cut off any communication between biological parents and the children they placed for adoption,” said Haley Horstman, Assistant Professor at the University of Missouri in the US. “Biological parents in open adoption relationships often feel more secure knowing more about the parents who adopted their children. We found that the best outcome for an adopted child is for adoptive parents and birth parents to jointly tell the story of adoption, when appropriate. This open communication between birth parents and adoptive parents has changed the nature of adoptions; birth parents have appreciated this new movement toward openness.”

Research indicates that the nature of adoptions has changed due to the benefits associated with the open communication and transparency between birth parents and adoptive parents. Each side has been grateful for the shift in adoption practices.

Fellow University of Missouri professor Colleen Colaner noted: “It’s important to get a sense of what the adoptive parents are saying to birth parents and what they are saying to the adopted child about their biological parents.”

For the study, the University of Missouri team of researchers studied themes from the narratives of 165 adoptive parents that provided future framework for how biological and adoptive parents can communicate with their children moving forward.

Oklahoma Post-Divorce Insurance Changes That Might Occur

Oklahoma post-divorce insurance changes

All sorts of changes occur when one goes through a divorce. These range from emotional, physical and financial adjustments one will need to endure. The iconic Tulsa law firm of Fry & Elder realizes this and wishes to provide you with some additional information and answers to some common questions in regards to Oklahoma post-divorce insurance changes that could transpire after a divorce. These include:

  • Health Insurance
  • Car Insurance
  • Life Insurance
  • Home Insurance
  • Disability Insurance

What Oklahoma post-divorce health insurance changes may I encounter?

For obvious reasons, health insurance is important. If you have your own health insurance you will be able to keep it active, but it becomes a little tricky if you’re a dependent. There are three health insurance scenarios that you will need to research.

Option 1 would be to buy an Oklahoma health insurance policy from a health insurance company.

Option 2 would be to get a health insurance policy through your employer if it is offered. You will want to talk to your supervisor or human resources director to learn more about the parameters.

Option 3 would be to continue to keep yourself on your ex’s health plan but pay for it yourself. This can be achieved by administering COBRA insurance as your coverage provider. Federal law mandates that individuals who suffer a significant life change such as divorce be given the option to buy continued coverage through the same coverage for as long as 3 years (36 months). If you wish to go with this option, you will want to contact a representative from your ex’s health insurance provider and let them know about the divorce and plans to elect COBRA.

What Oklahoma post-divorce car insurance changes may I encounter?

If you were on your ex’s auto insurance policy, you are going to want to research and shop around for the best policy. Word to the wise: get multiple quotes from different companies. If your ex was on your policy, you will want to notify your insurer about the divorce so that you can remove him or her from the policy.

What Oklahoma post-divorce life insurance changes may I encounter?

Some divorce agreements may force you to buy a life insurance and have your ex named as the beneficiary. This often comes into play because if an ex-spouse dies then the living spouse can use that life insurance policy as a replacement for child support of alimony.

Many who need to go this route will elect to choose term life. Typically, one will select a term in increments of five years such as 5, 10, 15, 20 or more years and then the amount of coverage you will need. The coverage will end once the term you selected ends.

If your divorce agreement declares that you are not obligated to any continuing financial responsibilities, then you might want to consider taking your ex off of an existing life insurance policy.

What Oklahoma post-divorce home insurance changes may I encounter?

You will want to notify your home insurance company once it has been finalized between who is moving out. The policy should be in the name of the homeowner once the divorce is complete.

If you are the one who is moving out of the residence, you might find temporary residency at an apartment or condo. If this is the case, you will want to research and shop around for the best renter’s insurance. Standard Oklahoma renter’s insurance provides liability coverage and covers your belongings.

If you have moved out and are in the process of buying a house, you will want to contact multiple home insurance companies to get the best rate and coverage plan.

What Oklahoma post-divorce disability insurance changes may I encounter?

Disability insurance is an afterthought by many in comparison to life insurance, but studies show it should not be overlooked. Let’s put it this: The average person has a greater chance of going on disability insurance for 90 days or more than the average person does dying before retirement.

Couples should plan accordingly for disability insurance before the divorce is finalized. If you drawing and income from working, you are going to want to have disability insurance. If you are going to rely on child support or alimony as your primary source of income, then you will want put in the divorce agreement that your ex will need to have disability insurance coverage.

Why experience the Fry & Elder difference?

Whatever questions you have in regards to Oklahoma post-divorce insurance changes, the Tulsa law firm of Fry & Elder is happy to help. Fry & Elder has been synonymous with Tulsa family law for over 40 years.

Tulsa Adoptions Attorney Sheds Light On Adoption Process

Tulsa adoptions attorney

The way Hollywood sometimes spins it and the way the media often sensationalizes it, there are a lot of people who have a connotation that adoption can be red-tape, legal nightmare. That, however, really is not the case. Whether you are looking to adopt in Tulsa or somewhere else, plenty of adoptions have and continue to take place. In fact, the State Department reported that 501 adoptions took place in Oklahoma between 2010 and 2015.

Tulsa adoptions attorney and Fry & Elder’s Luke Barteaux says the word adoption can conjure up some uneasiness, but it does not have too, saying: “Some people hear that word and they just start assuming that adopting is an act that will be really tough to execute. That’s not really the case at all, but there are channels one must cross to adopt.”

Why People get the Wrong Idea About Tulsa Adoptions?

First off, if you are thinking about adopting, you need to be aware of that in the United States there are numerous adoption avenues one can take. This, however, should not be misconstrued as a bad thing but as a very good thing. Multiple options, in the legal system in particular, are very good indeed.

There are international or overseas adoptions, which may have specific conditions that need to be met depending on the country of origin. Adoptions in Tulsa and the rest of the U.S. typically fall under three classifications:

  • Independent Adoption (without and agency)
  • Domestic Adoption (through an agency)
  • Foster Care System Adoption (adopting a child that is in the care of the state)

This might seem like a lot to take in and it is to a degree. Just like so many other things in life there are advantages and disadvantages to each type of adoption, making it all the more important to seek consultation with a proven, experienced and accomplished Tulsa adoptions attorney.

Tulsa adoptions attorney

Luke Barteaux

How Do Independent Adoptions Typically Work?

Independent adoptions typically take place with the birth mother and prospective adoptive parents negotiating the adoption without involving an outside agency. An adoption attorney is needed to mediate the process and make sure that everything adheres to proper legal procedure. Oklahoma and most other states allow independent adoptions to take place, but they are illegal in Colorado, Connecticut, Delaware, Massachusetts and North Dakota.

How Do Domestic / Agency Adoptions Typically Work?

In this case, domestic Oklahoma adoptions and elsewhere incorporate the services of an outside agency where the prospective adoptive parent typically is not in direct contact with the birth parent or foster care system. These adoptions are beneficial for adoptive parents who need or feel more comfortable using the services of a “go-between,” which is essentially the role an agency plays in matching children with parents. That said, not all agencies function alike. Some agencies provide more services than others and some work on a national level, while others focus on one state. If you are considering going with a domestic adoption, know going in that there are disparities between agencies and that you are not using an overnight adoption service.

How Do Foster Care Adoptions Typically Work?

While prospective foster care adoptive parents will have to go through a training program that is closely monitored by state authorities, there are some inherent advantages to adopting through the foster care system. These benefits include but are not limited to many adopted foster care children receiving state subsidies and that some public agencies don’t charge a fee for services when you adopt a foster child.  Those looking to learn more about foster child adoptions should visit AdoptUSKids.org.

How Do Foreign Adoptions Typically Work?

Just like domestic adoptions, those expecting a quick match are not likely going to find one from a foreign adoption. However, many may be surprised to know that wait times are usually shorter for foreign / international adoptions than other types of adoptions. This primarily stems from the fact that there usually are more children available, which often is not the case in domestic adoptions. This also is often the case because unlike some independent adoptions, the adoptive parents do not have to factor in a birth parent becoming uncertain in a foreign adoption. The potential drawbacks of foreign adoptions are that they usually are more expensive, involve language barriers and babies are not readily available.

Why Experience the Fry & Elder Difference?

Adoptions do not have to be as difficult or time consuming as many people make them out to be, but if you are looking to adopt, you are going to want to have a well thought out game-plan and strategy intact before proceeding. This can be effectively accomplished by consulting with a proven and experienced Tulsa adoptions attorney. Barteaux devotes much of his legal practice to adoptions. He has been selected as as a SuperLawyers® Rising Star and is a 2016 graduate of the Oklahoma Bar Association Leadership Academy.

In addition to Barteaux, firm attorneys Robert G “Hap” Fry Jr., James R. Elder, M. Shane Henry, Aaron D. Bundy, Lorena Rivas, Katie Egan, Kirsten Bernhardt and Melissa Fell have each garnered numerous accolades throughout the years to help Fry & Elder achieve elite status on both state and national levels. Tulsa Lawyer of the Year

The media exposure continues for Fry & Elder. The iconic Tulsa family law firm has been featured in this month’s TulsaPeople Magazine, marking the third time the Tulsa media has profiled the law firm since April 14.
